I live in Texas and I am going to be buying a home in October. I don't know which home warranty to purchase. I have heard good and bad about several companies.
Most are not worth the paper they are printed on. If you look at the fine print you will find that they have left themselves "outs" all through their policys. If you don't report a problem in a timely manner. If you have a heating man come to diagnose your heater problem it voids the insurance because someone else just looked at your heater.
Like most insurance it is a scam. That being said their are a few companys that are more reputable than the others. I am in Vietnam right now so I don't have my files with me and can't give you names off the top of my head.
But... the leaders in the business are Continental and First American. Read your fine print and record your conversations with their agents. They will do everything in their power not to pay your claims. Most of these companys still owe money to the people in Northridge and New Orleans. Rip offs.

anyone have an opinion on its value or worth? either to the builder or buyer? i reviwed its guidelines and it dont seem like there is and protection of much value to the homeowner. i want to build to sell but find this is expensive and a bit useless. not much is covered. and it seems like a lot of trouble to become a member of. has anyone felt it was worth having or any buyers find it was important or useful?
If you want to build houses to sell them, and you don't yet know anything about the various new home warranty programs available for purchase, I respectfully suggest you're in water way over your head. I worked for professional homebuilding companies 20 years before I started my own company 9 years ago, and I've been a member of MENSA for a long time. It ain't easy to do it right.

I just purchased my first home 5 months ago. When the people came to do the home inspection they checked the air conditioning and I don’t remember if they checked the heater. I purchased the home in the summer time. Now that its winter I am using the heater and it is leaking very bad and it is causing fumes in my home. Is there anything legally I can do to make the previous homeowners liable for covering the charges for a new oil heater? I called the lawyer I used for my closing and I am waiting for a return phone call.

The sellers ARE liable if they knew and didn't say.
The Inspector IS liable if it was obvious and he didn't catch it. (and the heating system is a MAJOR part of an inspection).
The buyers agent IS liable if he didn't check it out or if he missed a 'red flag'.
There are 3 different stages to this. FIRST, you may have a Home Warranty Policy (common on re-sale homes, good for one year). These are pretty typically provided by sellers and are essentially insurance policies that cover this kind of thing and keep all of us out of court. Give them a call (your agent or atty will have their info) and they will send out a technician right away. It will cost you about $50 for a service call fee. This is not your homeowners policy - it is a separate one year policy.
SECOND - raise hell with your agent. In cases like this the squeaky wheel gets the grease. You do not need an attorney at this point. Give the agent(s) and the seller an opportunity to make this right. Let them deal with the inspector (they always give that limited liability crap, don't believe it). You should be able to get this fixed because it wasn't properly inspected/disclosed.
THIRD - Have your agent set up a mediation. This is better than court for you because it is informal. At this point you should consult an attorney, but 90% settle before this.

We had home warranty through American Home Shield when we bought our house. When we had a problem with our air conditioner we called to have it fixed and all the repairman did was charge us $50 and fill it with more freon. He did not "repair" the unit, just got it running again (similar to adding more oil to a car thats leaking oil. Doesn't fix the problem, just helps it limp along.
