Can a person be evicted from a home they own in Lexington, North Carolina?

My sister is a widow, a Canadian citizen but a permanent resident of the USA.

Before his death, her husband had owned half the house, her father-in-law had owned the other half but fearing he might one day have to go into a nursing home, he made her his heir and did a quick deed, signing his half of the house over to her.

She now owns the house but her father-in-law has a legal right to live in the house for as long as he lives. He has tried to get her to sign the entire ownership over to him and has just presented her with a notice to evict (handwritten, not an eviction notice). Can he do this?

She has minimal income (Canadian disability) and can not afford a lawyer. She has no means of transportation (she signed her car over to him but he won't let her ride in it) so she can't get to the doctor, grocery shop, etc. He is making life difficult for her, has disconnected the internet, phone, given away furniture (no paperwork on who owns the furniture) and has threatened her and her dog.

He wants her to sign the house back over to him. He just gave her notice to vacate. Can he force her out of the house she owns?
Her father-in-law has a new girlfriend who wants the house and who has been putting ideas into his head. My sister is on Canadian disability pension, she's a permanent US resident. I live in Canada and she in North Carolina, USA. Her FIL wanted the car and she couldn't afford the insurance after her husband died so she signed it over to him. She got a cell phone but can't afford to buy a clunker or the insurance. She has no wood for the furnace, no way to get groceries unless a church member drives her. Her FIL was afraid that he or his late wife would have to go into a nursing home and loose the house. It was his idea, he took her to HIS lawyer. She has in irrevocable trust in which the house goes to her grandson. He (the FIL) made it difficult for the grandson to live there and he came back to Canada. She really needs help.
He has a right to live in the house for as long as he lives because that's the way the quick deed was drawn up. He took my sister to his lawyer because he initiated all this, fearing he or his late wife would have to go into a nursing home. My sister cared for his invalid wife (her mother-in-law) until her death. My sister has no money except for a Canadian disability pension. She can not sell the house due to the irrevocable trust she set up in her grandson's name. Can he (the father-in-law) force her to leave?
Her husband died about three years ago and her mother-in-law died about 1 1/2 years ago. Her father-in-law has additional property (many, many acres) with a house on it which he farms. He lives in my sister's house which she owns 100% of because he had that stipulation put into the quick deed he drew up. My sister has only a disability pension to live on, no medical coverage and no wood to heat the house. She really and truly needs help and I'm so far away (in Canada).
I looked up on the internet and found a North Carolina Legal Aid place. I faxed them in brief intro telling them she would phone them in the morning. She tried over 20 times cut could not get through. Does her father-in-law honestly think he can evict her from her own house?


There's more to this story than you're telling us. How and why does he have a "legal right to live in the house"? Does that right preclude her from selling the house she owns?

I would suggest that she SELL the house to him at fair market value and come move in with you. Better yet, she should sell the house to a third party and let them evict the father-in-law.

If I was an annoying father-in-law, I wouldn't do anything to piss off my heir. He runs the risk of not waking up one morning.

Place an ad in the local paper where you are now and check all bulletin boards. And you should put a notice on the supermarket bulletin board, look in the local newspaper and yellow pages to see if you can hire a driver. Don't forget about word of mouth. Be careful and Good luck!

First Air Force move/Barksdale AFB?

My fiance and I are getting married next weekend and he will be graduating AF tech school November 9th. By the time he goes on leave I should be on his orders [according to his recruiter] and we will be moving to Barksdale AFB. I am currently in California getting everything ready on my end and trying to plan the move along with figure out what type of area we will be living in. For all those people that are familiar with the base and the area around it, we are seriously considering Lexington Apartments [off base housing]. I was also wondering if it would be a better call to buy furniture out here and have it sent to our home there or should we just go with nothing and buy there! We will be moving out of our seperate family homes and into our first palce together out there. And with that in mind will the Air Force move us? My fiance told me about TMO but i cant find much info on it so i was hoping someone with experiance can give some words of wisdom. Just trying to find out what my job is in this situation!
We dont have a car right now and are looking into getting one in Bossier. For now flight will be our only option and as far as him coming back to California:: Our families would like to spend some time with us too before we leave! They haven't seen him for MONTHS and they really miss him! We also have a reception planned since not everyone can make it to Texas for our wedding.


if i were him i would do a DITY move.. it is very stressful and generally kind of expensive initially, BUT you get reimbursed for the mileage and Weight of the cargo you are hauling.. u just get a dry Weight of the car and uhaul attached then get a full weight both in cali and when you arrive in Louisiana.. i want to say it is $0.35 per mile and just under a dollar a pound up to around $8000.00 total.. so in the long run you will actually make a little extra cash..

help! night table water damage/scratch?

I recently bought a new bedroom set. On one of the night tables, my daughter decided to put her cup of water there and it spilled...she didn't tell me. It might have been there for 30 minutes but not longer. The wood grain isn't 'smooth' in that spot anymore, it has a slightly rough feeling and is raised a little, sort of bubbled i guess. It isn't very noticible unless you look closely or feel it, but its so new and driving me crazy since I haven't even paid it off yet!

Is there anything I can do to fix it? If I have to refinish the top of it, how do I do it? Also, the dresser -- part of the same set, has a scratch on it, someone rested a tv on it while carrying it....how do I fix it? it took the finish right off, and its on the front edge of the dresser - very noticible.

Does anyone know the best way to clean this type of furniture? I'm not sure what its made of but I doubt its real wood. Thank you SO much!

You are dealing with a veneered piece of furniture (says it on the website), which makes things a bit more difficult.

When water sits on top of a veneered surface, it expands the veneer and lifts it off the adhesive below. Repairing the surface may prove to be difficult, especially if it is "bubbling" like you said. On the other hand, if it isn't very noticeable, refinishing it can be a snap.

With 220 grit sandpaper in the palm of your hand, gently sand the damaged surface with the grain of the veneered surface. If you sand too aggressively you may remove the stain, which will make everything look worse, unless you were to find a stain that matched--unlikely. Using an oil-based polyurethane that matches the "sheen" of the furniture, apply with a rag or brush (you will need to clean the brush with paint thinner). One coat should do it, assuming the repair is small. After waiting 48 hours, sand with 000 steel wool to polish the surface. Then clean with pledge.

With regard to the scratch, you will need to find a stain that matches. Apply stain with a rag on test piece of wood to ensure stain is accurate. When confident the stain will match, prep the damaged area by sanding. Apply stain to area. Wait 24 hours. Apply poly. Wait 48 hours. Polish. Clean.

If your are meticulous about keeping your things nice, I would really practice refinishing less desirable furniture before you tackle your brand-new bedroom set. Another option is to hire someone qualified to repair your furniture. With this economy you should get it done for under $250.

I am sorry for the damage, I know how frustrating it is--kids!
