what legal actions can I take in order to force my wife to come and remove her furniture from my home?

I just want to do things properly according to the law. Family court claims that they don't handle such matters. Please enlighten me with the proper channels if any!!


Just a thought, talk with your lawyer, but what if you would pay to have the things move? if she still refuses I would pay to have the stuff moved to a self storage unit pay for a month rent and let the wife know where her stuff is located

Being taken to small claims court for furniture account- information?

I am in NC. My husband and I got furniture from a buy here pay here furniture store in March 2008. He was the only person working at the time, and they approved us on his credit alone, then he suggested I sign the contract as well to help my credit (they told us they reported monthly), so like an idiot, I did. We seperated in May 2008. He came to get the furniture from the home, I called the police, and they told us since it was marital property we both had claim to it, and that since he had the job and could make the payments, it would be in the best interest of both of us to give it to him. He took the furniture. I later found out he'd sold the furniture ($5000 worth) to his girlfriend's parents for $400. I called the furniture company and told them what had happened. I told them the address and begged them to go repossess the furniture. (He had missed a month, then two months of payments.) The did nothing. I told them he was going to sell the furniture, and they told me that he couldn't do that legally. Nonetheless, here we are now. We were seperated then, and are still awaiting a divorce (messy custody case). I just recieved a notice for a small claims case from the furniture company, but it just has my name, not his. What, if anything, can I do? Anyone know of any loopholes here? Anything I could use as a defense?
It was an abusive relationship, and I was young- and stupid! I see that I need to file an Answer to the Complaint- I have no clue how to do that, what form to use, etc. I realize I'll still likely have to pay it, or get a judgement against me, even though I was not the primary. Hard hard lesson, I suppose!

You cosigned for the furniture. That means they can sue you if he doesn't pay.

If he has the furniture, then you can sue HIM to get your money back if you lose.

Creditor taking furniture, etc. from your home?

I had a man from a debt management (credit counseling agency) tell me that if a credit card company took you to court and got a judgement, then they could take things out of your home if you bought them with the credit card such as furniture, appliances, etc.
Was he just telling me this to try and get me to sign up with his company or is this true, can a CC company really do this?

No, this was not the collection agency that told me this. it was a man from a credit counseling agency. I was talking with them to try and see if I could get help with the debt.


If it is Unsecured debt, which credit cards are, they can not do that. Even if you bought the furniture on the credit card in question they could not take it back. If you read the terms and conditions of the card there will be a line to the effect that "They do not maintain a security interest on the items purchased"

They are not allowed to threaten you with actions they can not legally take or have no intention of taking. If you are in the US this may be a violation of the Fair Credit Reporting Act. It really depends on exactly what he said. If it is you can actually file suit against them for damages, I beleive the current amount is $1000 per violation.

Now they can take still take you to court. But the court may allow them to garnish your wages or try to attach your bank account but they can not take your physical property for unsecured debt.

If he calls again, get his name, phone number, the time and date he called. Let him know that that it sounds like a violation of the FCRA and if they call again you will pursue legal action.

What are my options regarding the personal property of a person ordered by the court to leave my home?

My family was recently forced to file for a peace order in the state of Maryland to remove an extended houseguest from our home. The district court issued a final peace order with the added instruction she was to pick up her personal property today 2/5/2009 between the hours of 0930 and 1530 with a police escort. The respondant showed up this morning without any help, or a proper vechicle. The deputy with instruction of his shift commander refused to stay while she made multiple trips. She left our property around 1230 and never returned to claim any more property. There is a fairly large amount of furniture left unclaimed. I fear moving it to one central area in my house due to fear of possible civil action due to damage. I want to return my home to normal, and would like some advice on my options be it a petition to the court or hire a lawyer (and what specialty). I dont want this to turn into a financial or legal nightmare any further than it already has.


I would contact the person who was tossed and ask when she is coming to get the rest of her stuff. Then I would go to the courthouse and talk to the judge's clerk and ask what to do. She can check with the judge. This is if you get no response from the tossed one. You can request an order of Non Pro Tunc, which corrects the order to reflect that after day x, you can dispose of the property.
